How to Prove Your Medical Malpractice Case

There are a few things you should consider to establish a case for medical malpractice.  The plaintiff must prove that:

  • The defendant had a duty to the plaintiff.
  • The defendant failed to meet the standard of care owed to the plaintiff.
  • The mistake actually caused the plaintiff's injury.
  • The doctor or other medical professional's negligence damaged the plaintiff.
